Terms and Conditions of Use

1. Purpose

Citali is a mobile application that allows users to make, manage, and cancel bookings at affiliated establishments, subscribe to gym memberships at affiliated gyms, as well as receive notifications about appointment availability and manage their personal data.

2. Registration and Account

• To use the application, it is necessary to register via email and password or through Firebase Google Authentication, providing real and truthful data.
• The mandatory data for registration are email and name. Phone number and date of birth are optional.
• The user is responsible for maintaining the confidentiality of their access credentials (password or associated Google account).
• At any time, the user may modify their personal information (email, name, phone, and date of birth) or delete their account from the application itself.

3. Bookings

• The user may make bookings at affiliated establishments.
• The user may cancel their bookings from the application, respecting the internal policies of each establishment.
• Data from all bookings (past, present, and future) will always be available for user consultation in the application.
• Workers and/or the establishment may delete bookings when deemed necessary (for example, closures, incidents, or internal organization).
• The establishment reserves the right to set limits on the number of bookings per user.
• In case of repeated non-compliance with rules (e.g., booking and not attending without prior notice), the establishment or its workers may block the user temporarily or permanently.

4. Notifications, Subscriptions, and Google Calendar Integration

• Users may activate or deactivate push notifications at any time.
• Users may subscribe to full days to receive alerts when booking slots become available.
• Users may enable or disable automatic synchronization of bookings to their device calendar and Google Calendar.
• Google Calendar Integration: If you enable this feature, Citali will create automatic events in your Google Calendar when you make or cancel bookings. You authorize Citali to access your Google Calendar solely for this purpose. This integration:
  • Only works if you explicitly enable it in the application
  • Can be disabled at any time from the application
  • Can be revoked from Google Account Settings (Connected apps)
  • Does not share your calendar data with third parties

4.1 Membership Centers

• Gym-type establishments affiliated with Citali may offer recurring subscription or membership plans through the application.
• To sign up a new member, the gym's worker may enter the email address of the person they wish to invite. The system will check whether a Citali account associated with that email exists and, if so, allow the worker to send them a membership invitation, regardless of whether that user has prior bookings at that gym.
• The invited user will receive a push notification and must expressly accept or reject it. The membership will only be activated if the user accepts the invitation.
• Tracking of membership payments (fees, due dates, and reminders) is managed manually by the establishment. Citali does not process payments or store banking or card data through this feature.
• The user may pause, freeze, or cancel their membership from the application at any time. Cancelling a membership does not delete the user's general Citali account.
• If the membership includes group classes with a family option, the member or the establishment itself may record the first and last name of minor children as attendees. The member, as parent/guardian, consents on the minor's behalf and may request the modification or deletion of this data at any time.

5. Day Management and Availability by the Establishment

• Workers may block entire days on which bookings exist.
• In such cases, users with affected bookings will be automatically notified.

5.1 Responsibilities Regarding Google Calendar

• Citali is responsible solely for the correct technical synchronization with Google Calendar
• Events created in your calendar are your responsibility; you can edit or delete them freely
• Citali is not responsible for changes, errors, or incorrect synchronizations if the Google integration does not work properly
• Google Calendar integration is subject to Google's Terms of Service

5.2 Member Sign-Up at Membership Centers

Gym-type establishments may sign up members by entering their email, without the process being initiated by the member themselves. By using this feature, the establishment represents and warrants that:

• It has a prior relationship or authorization with the person being signed up (in-person request, paper form, or other verifiable means outside Citali) before entering their email into the platform.
• It will not use this feature to check whether a specific email has a Citali account for purposes other than signing up a real, consenting member.
• It is responsible to the member and to third parties for any misuse of this feature by its staff, including revoking access for employees who no longer work at the establishment.

Using this feature with the emails of people who have no real relationship with the establishment, or to find out whether a third party has a Citali account, constitutes a breach of these terms and may lead to suspension of the establishment's account.

Regarding the processing of gym members' data, Citali acts as a data processor on behalf of the establishment (the data controller), on the same terms already indicated in the Privacy Policy for the rest of booking data.

5.3 Client Records, Clients Without the App and Merging by Phone Number

Establishments can record bookings for clients who do not use the app and keep in each client's record their visit history, amount spent, technical service data, photos of the result, notes and payments. If a client without the app later signs up for Citali with the same phone number, the establishment will see that they "have the app now", with the account's name and email address, and can merge their history into it. By using these features, the establishment represents and warrants that:

• It informs its clients without the app that it records their data in Citali and has a legal basis to do so, as data controller.
• It only records data necessary to provide the service and does not store health data or other special categories of data in the record, unless it has the legal basis and safeguards required by law.
• It only photographs the result of the service with the client's consent.
• It will not use the "has the app now" detection or the phone search to find out whether a person has a Citali account for purposes other than serving its own clients.
• Before merging, it checks that the account belongs to its client, especially when several accounts share the same phone number, and handles requests to correct or delete the data it recorded.

A user who signs up with a phone number that an establishment already had linked to previous bookings accepts that the establishment may link those bookings to their account. From the merge onwards, they will see them in the app and receive reminders for upcoming appointments.

For this data, Citali acts as data processor on behalf of the establishment, on the terms described in the Privacy Policy (sections 1.7, 1.8 and 5.3).

6. User Rights and Responsibilities

The user agrees to:

• Use the application lawfully and in accordance with these terms and conditions.
• Not make fraudulent use of the booking system.
• Provide truthful and up-to-date information at all times.

Failure to comply with these obligations may result in the suspension or deletion of the user's account.

7. Limitation of Liability

• Citali acts solely as a technological platform for booking management.
• Compliance with service provision (schedules, attention, quality, cancellations) is the exclusive responsibility of each establishment.
• Citali is not responsible for losses, damages, or harm arising from the relationship between user and establishment.

8. Intellectual Property

All intellectual and industrial property rights over the application, its content, logos, design, and code belong to Citali. Unauthorized reproduction, distribution, or modification is prohibited.

9. Modifications

Citali reserves the right to modify these Terms and Conditions at any time. In case of relevant changes, users will be informed through the application or by email.

10. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law. For any dispute, the parties expressly submit to the Courts and Tribunals of the city where Citali has its main headquarters, unless consumer protection regulations establish otherwise.
